Outlands LoP dated 2012-12-09

Outlands College of Heralds

December 9, 2012 From the Office of the Castle Herald

Sayyidah Khalidah bint Yahya'a

castle@outlandsheralds.org

Unto the Outlands College of Heralds, our respected friends and colleagues who give freely of their time to provide commentary, and all others who come by these letters, on this 9th day of December, A.S. XLVII (2012 CE), does Sayyidah Khalidah bint Yahya'a send greetings on behalf of Mistress Fiachra ni Ciardhubhain, White Stag Principal Herald. It would assist Castle Herald greatly in the future if you would e-mail a copy of the documentation summary for name submissions along with the paper copies. It saves having to re-type everything again. Also, please be sure that you include dates of registration and return for armory for previously registered names and resubmissions of any kind. If Castle can't find where an item was returned, it may be pended until the information is provided or payment is made for a new submission.

Here follows the Kingdom of the Outlands' Letter of Presentation for December 2012. Your comments and suggestions are always welcome. Errors found herein are my sole responsibility. Anyone may comment upon the items found herein, and e-mail commentary to the herald's commentary list is encouraged. Please have comments on items contained herein to Rampart Herald by January 15, 2013, for the decision meeting tentatively scheduled for January 16, 2013. As a reminder, the College of Arms requests commentary on all items, including appeals.

{Returned for Redraw. The SCA does not register single diminutives of ordinaries, and the positioning of "abased" is no longer accepted.  If the submitter wants a chevron, it needs to be the primary charge on the device.  A stylistically similar option that would present fewer problems would be to just use a base point rather than the chevronelle.}

Consulting Herald: Conal Mór MacNachtan

Old Item: Paly sable and argent, on a chief vert two rapiers inverted in saltire Or, to be released.

Submitter's previous device change, Azure, six oak branches conjoined in base, leaved and fructed argent , was returned on the July 2012 LoR (http://rampart.outlandsheralds.org/2012-06-lop/1207-lor.html) with the following:

{Returned for visual conflict.  As drawn, this device is visually very similar  to an escarbuncle or snowflake, which brings it into visual conflict with Christel Leake [March of 2007 (via Caid)]: Azure, an escarbuncle argent and a base rayonny Or.}

Submitter disagrees with the visual conflict/escarbuncle sentiment and has provided a device image of an escarbuncle to show the difference between the two.

[Malinda] - Cites that there are 'Malinda' names on the O&A, it is also the submitter's mundane middle name but no identification item was provided

[of] - Submitter will also accept 'atte' in place of 'of' if needed to have the name accepted

[Mousehole] - a fishing village in Cornwall, founded in the 13th century. (http://www.cornwalls.co.uk/Mousehole/) (http://www.victoriacountyhistory.ac.uk/explore/items/mounts-bay-and-its-ports-1600 )

Consulting Herald: Selene of the Sky

Correction (2012-Dec-17 22:12:43): The submitter is unable to provide identification for her middle name as all easily accessible documents have just the middle initial. As such, the submitter has decided to change Malinda to Malina and has provided the following documentation:

[Malina] - 'Feminine Given Names in A Dictionary of English Surnames', Talan Gwynek (http://heraldry.sca.org/laurel/reaneyHZ.html)

13: Seamus O Mourane -Resub Device

OSCAR finds the name registered exactly as it appears in June of 2012, via the Outlands

Submitter's name is on the June 2012 LoAR (http://heraldry.sca.org/loar/2012/06/12-06lar.html) via the Outlands.

Submitter's previous device, Per chevron argent and azure, two sea dragons combatant and a mullet of seven points voided and interlaced, counterchanged, was returned on the September 2010 LoR (http://rampart.outlandsheralds.org/2010-08-lop/1009-lor.html) with the following:

{RETURN for lack of a name with which to submit it (the name was returned at Kingdom on the July 2010 LoR, so at this point there is no name to which to link this. Therefore it must be returned.)}

Submitter has resubmitted the same device now that his name has passed.

Consulting Herald: Yasamin al-Hadiyya

14: Sean O Faolain -Resub Appeal of Laurel Return of Name

Submitter desires a masculine name.
Client requests authenticity for 16th Century Irish.
Sound most important.

[Sean] - 'Index of Name in Irish Annals: Seán (Seóan)' by Kathleen M. O'Brien (http://medievalscotland.org/kmo/AnnalsIndex/Masculine/Sean.shtml)

[Faolan] - 'Index of Name in Irish Annals: Fáelán (Faolán)' by Kathleen M. O'Brien (http://medievalscotland.org/kmo/AnnalsIndex/Masculine/Faelan.shtml)

Submitter's name, Sean O Faolain, was returned on the Jan 2012 LoAR (http://heraldry.sca.org/loar/2012/01/12-01lar.html) with the following:

{This conflicts with the registered Senán Ó Fáeláin. Precedent says: While Mariot is not a diminutive of Gaelic Mairi, the difference in pronunciation between the two names, which is only the addition of an unstressed terminal syllable, is not a significant difference in pronunciation. [Mairi Berwyk, LoAR 04/2009, Ansteorra-R] This case is equivalent. His device has been registered under the holding name Sean of Hawk's Hollow.}

Precedent says:

While Mariot is not a diminutive of Gaelic Mairi, the difference in pronunciation between the two names, which is only the addition of an unstressed terminal syllable, is not a significant difference in pronunciation. [Mairi Berwyk, LoAR 04/2009, Ansteorra-R]

This case is equivalent.

Substance for appeal

Under the new rules, though, is this clear by PN.3.C.2? The rule reads as follows:

"Names are substantially different if a single syllable between them (excluding articles and prepositions, such as de and the) is changed in both sound and appearance as described here. The addition or removal of a syllable makes two names substantially different in sound. Two names are also substantially different if a syllable is substantially changed in sound and appearance. This means that the vowel and the consonant (or group of consonants) on one side of the vowel is different between the two names. In either case, the change in spelling (including addition or removal of letters) must affect at least two letters in that syllable to be substantial."

I see the removal of the second syllable from Senán, which counts as a substantial change of sound. As far as the required spelling change, the removal of the -án from the second syllable of Senán should meet the required "change/add/remove two letters" benchmark--the rule says change to the syllable, not change to the name as a whole.

(Intuitively, this seems to have as much difference as the provided-as-substantially-different examples of "Connor" vs. "Conall".)

Consulting Herald: Eric Morrison

15: Ulrich Tanhauser -New Name & New Device

Or, a wolf passant and in chief three paw prints sable

Submitter desires a masculine name.
Language (German) most important.
Culture (German) most important.

[Ulrich] - 'German Names from Nürnberg, 1497' Sara L. Uckelman (http://heraldry.sca.org/names/german/nurnberg1497.html)

[Tanhauser] - 'German Names from Nürnberg, 1497' Sara L. Uckelman (http://heraldry.sca.org/names/german/surnamesnurnn-z.html)

Consulting Herald: Magdalena Lucia Ramberti

Thus ends the December 2012 Letter of Presentation.
